The mother of a three-year-old boy who drowned at a water park in 2023, while she allegedly sat nearby and stared at her cell phone, has been indicted by a grand jury in connection with his death. A Texas grand jury returned an indictment this month against Jessica Weaver, 35, on one count of injury to a child causing serious bodily injury in connection with the death of her son, Anthony Malave. Anthony drowned on May 13, 2023, at the Camp Cohen Water Park in El Paso, Texas, which the mother and son were visiting for the park's soft opening. According to a police complaint affidavit obtained by PEOPLE, the boy was found by a lifeguard in four feet of water and transported to the hospital, where he died.

A mother was indicted and charged after her 3-year-old son drowned at a water park in Texas. Anthony Leo Malave drowned in a pool at Camp Cohen Water Park in 2023, according to KFOX. Anthony’s mother, 35-year-old Jessica Weaver, is charged with her son’s death. She was charged with injury to a child/elderly causing serious bodily injury or mental deficiency. Weaver is accused of failing to provide care, give Anthony a life vest, be in the water with him, follow the water park’s rules, keep Anthony in her sight, provide or request CPR and keep Anthony out of the water soon after eating.

A mother who allegedly couldn’t be bothered to look up from her phone while her 3-year-old son drowned nearby at a Texas waterpark has been indicted nearly two years later. Jessica Weaver, 35, is charged in connection with the death of her son, Anthony Malave, who drowned in May 2023 during a soft opening at the new Camp Cohen Water Park in El Paso. One of 18 lifeguards working at the park pulled the unconscious boy out of a 4-foot-deep section of the pool. He was rushed to the hospital where he died, police said.
